Acceptable Use Policy

1. General.

§ 1st - This Acceptable Use Policy (this “Policy”) sets forth guidelines for the acceptable use and describes prohibited uses of AllITHost’s Cloud Services and network.
§ 2nd - All Subscribers to AllITHost’ services are required to comply with this policy.
§ 3rd - Any examples described in this Policy are not exhaustive.
§ 4th - If you violate the Policy or authorize or help others to do so, we may suspend or terminate your use of any of our products or services you may be subscribing.

2. No Illegal, Harmful, or Offensive Use or Content.

§ 1st - The AllITHost network and Cloud Services may only be used for lawful purposes.
§ 2nd - Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited.
§ 3rd - You may not use, or encourage, promote, facilitate or instruct others to use, the Cloud Services or any other service or product provided by AllITHost, for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive. Prohibited activities or content include:

(i)              Illegal Activities. Any illegal activities, including advertising, transmitting, or otherwise making available gambling sites or services or disseminating, promoting or facilitating child pornography.
(ii)             Harmful or Fraudulent Activities. Activities that may be harmful to others, our operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g., make-money-fast schemes, Ponzi and pyramid schemes, phishing, or pharming), or engaging in other deceptive practices.
(iii)            Infringing Content. Content that infringes or misappropriates the intellectual property or proprietary rights of others. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is libelous, defamatory, constitutes an illegal threat, violates export control laws or regulations or encourages conduct that would constitute a criminal offense or give rise to civil liability.
(iv)            Offensive Content. Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts.
(v)             Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.

§ 4th - AllITHost reserves the right to determine, in its sole discretion, whether any particular conduct violates such norms and expectations.

3. System and Network Security.

§ 1st - You may not use the Services to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”). Prohibited activities include:
(i)              Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
(ii)             Unauthorized monitoring or interception of data or traffic on any network or system without express authorization of the owner of the system or network.
(iii)            Interference with service provided to any user, host or network including, without limitation, mail-bombing, flooding, computer worms or viruses, deliberate attempts to overload a system and broadcast attacks.
(iv)            Falsification of origin, including the forging of TCP-IP packet headers or any part of a message describing its origin or route.
(v)             To establish network connections to any users, hosts, or networks, unless you have permission to communicate with them.
(vi)            Monitoring or crawling of a System that impairs or disrupts the System being monitored or crawled.
(vii)           Use any of the Cloud Services or systems provided by AllITHost to join any Distributed Denial of Service (DDoS) attack network or to originate Denial of Service (DoS) attacks, both understood as inundating a target with communications requests and network packets, so the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective.
(viii)          Operating network services like open proxies or open recursive domain name servers.
(ix)            Using manual or electronic means to avoid any use limitations placed on a System, such as access and storage restrictions.
(x)             Exploiting or attempting to exploit any scripts presented on a web page hosted in the Cloud Services or any other service or product provided by AllITHost.
(xi)            Hosting in the Cloud Services, or any other service or product provided by AllITHost, a web page which acts maliciously against users that visit that page.

§ 2nd - AllITHost prohibits the continued operation of servers or other services that have been compromised by third parties or automated agents.

4. E-mail.

§ 1st - AllITHost prohibits Subscribers from engaging the following e-mail related activities:
(i)              Forging e-mail headers, or assuming an e-mail sender’s identity without the sender’s explicit permission. This prohibition does not include the use of aliases or anonymous remailers.
(ii)             Running a mail server with open relay, i.e. which allows the unchallenged forwarding of e-mail.
(iii)            Distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or bulk e-mail (“UBE”, or “SPAM”) or other messages, promotions, advertising, or solicitations, including commercial, informational, advertising, political, or religious announcements.
(iv)            Setting up “mail-back” or “drop box” addresses in order to receive responses and/or collect replies to messages sent from another internet service provider if those messages violate this Policy or the acceptable use policy of that provider.

5. Abuse.

§ 1st - The following acts are considered to be abusive of the AllITHost network and are prohibited:
(i)              Any conduct which violates the accepted norms and expectations of the Internet community at large including, without limitation, posting or distributing information or materials which are abusive or threatening.
(ii)             Resale of any AllITHost services or products unless expressly authorized in writing by AllITHost.
(iii)            Falsifying Subscriber information in applications, contracts and other materials provided to AllITHost including fraudulent use of credit card numbers or “bill to” numbers.
(iv)            Falsifying identity or contact information to circumvent this Acceptable Use Policy or otherwise.
(v)             Attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilization or other methods to document use of AllITHost services.

6. Indirect Violations.


7. Monitoring and Enforcement of this Policy.

§ 1st - We reserve the right, but do not assume the obligation, to investigate any violation of this Policy or misuse of the Cloud Services or any other service or product provided by AllITHost.
On order to do so we may:
(i)              investigate violations of this Policy or misuse of the Services,
(ii)             remove, disable access to, or modify any content or resource that violates this Policy or any other agreement we have with you for use of the Services,
(iii)            suspend or terminate, either temporarily or permanently, any or all Services provided by AllITHost to Subscriber,
(iv)            block and/or filter any abusive activity or
(v)             take any other actions as deemed appropriate by AllITHost in its sole discretion.

§ 2nd - Nothing contained in this policy shall be construed to limit AllITHost’ actions or remedies in any way with respect to any violation of this Acceptable Use Policy.
§ 3rd - Subscribers who violate this Acceptable Use Policy may incur criminal or civil liability.
§ 4th - We may report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties.
§ 5th - Such reporting may include disclosing appropriate customer information.
§ 6th - We also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.

8. Changes to Policy.

§ 1st - AllITHost reserves the right to modify this Acceptable Use Policy at any time without notice. A current version of the policy is posted on AllITHost’ web site at: (THIS PAGE IS NOT FOUND)
§ 2nd - By using the Cloud Services or accessing any other of AllITHost’s products and services, you agree to the latest version of this Policy.

9. Reporting.

§ 1st - Subscribers to AllITHost’ services are required to immediately report to AllITHost:
(i)              any event or issue which could compromise the stability, service or security of the AllITHost network and
(ii)             any known violation of this Acceptable Use Policy.
§ 2nd - If you become aware of any violation of this Policy, you must immediately notify us and provide us with assistance, as requested, to stop or remedy the violation.
